Where do I go to bring my claim?

If you have opened an account with a brokerage firm in the Unites
States, you are almost surely required to arbitrate your dispute
because arbitration clauses in customer agreements have been
standard for some time. Other investment institutions, such as
banks, registered investment advisors, hedge funds and commodities
firms may be sued in court so long as the customer agreement
that you signed, if any, does not have an arbitration clause.

What is arbitration?
A.
Arbitration is a binding dispute resolution process which is
more informal than court litigation. The National Association
of Securities Dealers (NASD) and New York Stock Exchange (NYSE)
are the two primary forums that provide arbitration services
for aggrieved investors. In general, arbitration is less expensive
and faster than court litigation. Discovery is more limited.
Arbitrations are typically presided over by three arbitrators
who act as judge and jury. Arbitration awards are generally final
and binding. There are very limited grounds to vacate an arbitration
award in court. There are detailed rules and regulations concerning
arbitration. We highly recommend investors engage legal counsel
to represent them in arbitration matters.
